This workshop will cover the essential basics for family practitioners in respect of managing capacity issues in family cases/proceedings, drawing upon decisions made by the Family Court (and the Court of Protection) in respect of different types of "capacity" and the different thresholds for each (e.g. .litigation capacity, capacity to divorce, capacity to consent to a marriage, capacity to enter into nuptial agreements etc.). The workshop will also include a discussion on the duty of solicitors and barristers (to clients and the courts) when capacity issues arise, particular cultural and EDI considerations, and the range of support that can be put in place to support clients who may lack capacity.
